Artist’s T.O.S.
COMMISSIONING
- the artist retains the right to refuse any commission for any reason, stated or unstated.
- the artist will post all commissions publicly, unless specifically requested otherwise.
PAYMENT
- payment is due in full at the time of the piece being started (not at the time when the commission is accepted/the commissioner is placed in the queue; you will be contacted when your piece is ready to begin). For larger projects in excess of $150, the commissioner has the option to pay half at the time work begins and half upon final approval of the sketch phase.
- in cases of nonpayment (for any work where partial payment is due on completion), the commissioner will be provided with one week's notice for payment. If this deadline is not met, the artist reserves the right to rework the piece in order to rerelease it as a personal work, YCH, or adoptable.
PROCESS
- a queue of all currently scheduled commissions can be provided upon request.
- the artist will endeavor to notify all commissioners of any anticipated delays in a prompt and timely fashion.
- on all pieces aside from toned sketches, progress will be shown at the completion of the sketch phase for commissioner’s approval of posing, rough detailing, etc. It is the responsibility of the commissioner to clearly indicate any desired changes or corrections at this stage.
- beyond this stage, minor edits may be made once at no additional fee. Any major changes requested may incur additional fees at the discretion of the artist.
- for colored pieces and illustrations, multiple poses or thumbnails will be provided for consideration. A desired pose idea may also be requested by the commissioner, but please do not request that the posing and composition of another piece of art be replicated 1:1.
- the commissioner is entitled to regular updates on the progress of their commission (typically provided as pose>sketch>(revisions)>lines>flatcolor>final) if they so desire; if the provided updates are insufficient, a WIP may be requested at any time.
CANCELLATIONS
- once a piece is started, the commissioner may choose to cancel their order at their own discretion. If work has progressed to or beyond the final sketch stage, the artist is entitled to a ‘kill fee’ of half of the initial payment; all other payment will be refunded in full, along with the partially completed work.
- the artist retains the right to cancel a commission at any time, providing a FULL refund to the commissioner in the event this occurs, with no kill fee.
POSTING RIGHTS
- the artist retains the copyright to any imagery produced; if you wish to use this imagery for commercial use, rights may be negotiated for an increased price.
- the artist retains the right to publicly post WIP imagery and use completed commissions for their own promotional purposes, excluding commissions that have been requested to remain private.
- the commissioner is granted the right to repost the work on their own personal media accounts so long as credit is clearly indicated.
- the commissioner is granted the right to crop or resize the work for personal use only; minor manual edits can be made by the commissioner for the sake of adjustment or image repurposing, but requesting these edits through the artist is preferred.
AI & NFT
- the purchase of a commission does NOT bestow the right to resale for NFT purposes; any art intended for NFT sale must be negotiated with the artist and is subject to increased pricing equivalent to or exceeding commercial pricing.
- the artist does not consent to the use of commissioned imagery for AI training or AI editing/modification purposes. Commissioners found to have done so will be considered in breach of ToS and publicly blacklisted.
By choosing to commission this artist, the commissioner indicates that they have read, understand, and agree to the terms laid out here. Failure to abide by these rules will result in public blacklisting.
